    • The worker deserves 15 days indemnity during the first five years, and increases to one month after the first five years.
    • An employee who resigns, but does not complete three years with the employer, does not deserve an indemnity.
    • But if the employee completes three to five years and resigns, the employee then deserves half of the indemnity, if he completes five to 10 years, then he deserves two-thirds of the indemnity.

    Hi,I started working April 2017 as Household service working.And finished my contract for 2years but I extended for one year, so I’d been in my employer for 3years. I decided to go home. I was in my country for 2years. And just last May 2022 I came back in my employer. And signed again a 2years contract. My question is, will I be able to claim my indemnity from 3years of service before and this additional 2years that will end in 2024? And how much indemnity will I get if I claim it. My salary is still 120kwd.

    My Question is i am working since in IMCO from 9th March 2014 Till 11th August 2022 so means my total working days is 3077 and if we convert in the years, if i am correct is 8 years, 5Months & 02Days and don’t have any leave balance and i resign myself to join other company want to know how IMCO will calculate my total indemnity want to clear please.

    I need to know of how much the indemnity I will received working in the company of 7 years & 6 months.My salary right now
    is kd 550.00
    I asked the HR it is very less the amount given compared the google calculation in arab times.
    they calculate like this;
    5 yers @ 15 days = 75 x 2/3 = 50 days
    2 yers & 6 months.. not given

      Your Amount due should have been calculated like beow (If they Terminate you)
      First 5 Year (550/26*15)*5 = 1586.538
      Next 2.5 years = 550*2.5=1375.000
      Total amount due = 2961.538

      If you had resigned then you should get 2961.538*2/3=1974.359

    I resigned gracefully to the company and with 3 months notice period is in 1 week more to last!
    should the company be compulsory to give my benefits before i leave the country?
    what should i do if i cannot take my benefits in going home?
    and still i gave 1 week extension from the date of my last working days without pay, before my last departure date.

    my husband did finish a three years contract from his previous company…he even had a pending days approximately 14 days and his basic pay was 200 kd…if depending on this calcution…i believe he should not get just a total of 29kd as his indemnities…can we still file a complain regarding this issue and how?

    Can some one please advice…our company not paying the third part of our salary..ie 300 basic+ 200 allowencw + 150 PLI.

    Company only paying basic & allowence each month.The third part PLI is mentioned to get in contract/agreement but still company not given so far to any staff..till 3 years completed..pl some one suggest what action employee should take..

    Its not fair so whats the different between 2 employee if the other one is resign but in 5yrs also and the other one is finished the contract for 5yrs, and why its almost half of the imdemnity difference to each one? But in terms of working tenure they had the same 5yrs. Of working period.so its very unfair like us before working almost 13hrs. Or morethan a day with out payment for over time. Hoping you understand our workers.

    Calculation is wrong.
    While drafting the law, the law makers intended for the benefits of workers. Minor misinterpretations in the law which might not noticed while drafting the rules. Salary in Kuwait per month is for 26 days. Clause 1 says 15 days as they intended as half of the salary.

    So the worker should get maximum benefits in interpreting a labor law which is not clear. Not to the employers.

    Take an example of 10 year completed worker.

    clauses:
    1.The worker deserves 15 days indemnity during the first five years, and increases to one month after the first five years.
    2.An employee who resigns, but does not complete three years with the employer, does not deserve an indemnity.
    3.But if the employee completes three to five years and resigns, the employee then deserves half of the indemnity, if he completes five to 10 years, then he deserves two-thirds of the indemnity.
    4.If the worker completes 10 years of work then resigns, he deserves full indemnity which is one month salary for each year spent at work, according to Article 51 of Labor Law in the private sector, and should not exceed 18 months.

    Now Suppose a 10.1 years of serviced person’s calculation. Only clause 4 is valid in his case as the fist 3 clauses automatically cancels in view of his 10 years of service. Because he completed 10 years and resigns (clause 4). so clause foe solely valid here. So ten months full salary should be applicable to him. Some greedy / unknowing managements try to deduct fraction of indemnity of first 5 years which is not correct. They depend on clause 1 and try to add with clause 4. The argument is that first 5 years are included in the total service and after 5 years only one full month is applicable. Its not correct. If so why they are not considering clause 3 which is giving half of indemnity? So So the clause supersedes all the previous points (cluses 1-3) and only 4 is legally valid.

    I have been terminated by company with legal allegation, which is running in court presently. I have joined in the other co. and working presently.

    suggest the following:
    1. Try to get the previous employer’s opinion or calculation from them in writing.
    2. Try to negotiate with them.
    3. Get your lawyer to write a letter to them or negotiate on your behalf.
    4. File a complaint at shuoon Ministry of Social Affairs and Labor/a<

    I would like to ask regarding on Indemnity Laws & Calculations. I joint in the private office last October year,2004. then i resign last June,2018. to give formality in notice of 3-months according by Kuwait labor law. however, my basic salary is 730 kd. then i have 50 kd. stating this as transportation during working days to be paid at the end of every month. So, my salary in every month at the bank is 780 Kd.

    Then company terminated me and they did to pay me for 3 months and when I got new job they took 3 months salary from me to give me release
    My salary was 856 kd
    On iznay aml was 750 kd
    Salary certificate was 749 kd
    But the salty I paid to company to get release by paying 856 kd per month
    How much is my indemnity

    If the company terminate a staff and issued a 3 months notice for the staff to find a new job. My question is what if the employee got a job one month before the end of the termination? are they still entitled to get their last salary even they started working with other company during the termination period?

      Yes you are eligible for the indemnity of 15 days per year.(Please check with your HR, some companies have their own policies)

  55. Calculator is wrong here or may be i misinterpret it. Last line in rules explains that “If the worker completes 10 years of work then resigns, he deserves full indemnity which is one month salary for each year spent at work, according to Article 51 of Labor Law in the private sector, and should not exceed 18 months.” but if you calculate it both weather you resign or no calculation shows first 5 years 15 days salary per year and remaining years 1 month salary per year

    example : your salary if 800 and worked for 18 years. Amount should be 800 x 18 = 14400 K.D.
    but your calculator shows Indemnity amount 12707.692
    Please check and update your calculator or change the rules.

      I am not 100% sure about the article but below is what i know;

      First 5 years : 1/2 Salary (800KWD/2 = 400 KWD, 5 years x 400 KWD = 2000 KWD)
      Rest of the years : Full Salary (800 KWD x 13 years = 10400 KWD)
      Total Indemnity For 18 Years = 12400KWD (The calculator is showing almost the near value)

    But i had 3 times salary raise during 6 years.
    I started with 150 till 3 years.
    Then 200 for next 2 years and finally reached 500 for 1 year..
    How can i calculate indemnity total??

      Your indemnity will be calculated as per your current salary. After full 6 years of service below are the options;
      If you resign : 1293.577 KWD
      If got terminated : 1942.308 KWD

    staff salary 615 worked 20.5 years.

    1st five years comes 1774.038

    2nd Step (18-5) = 13 * 615 = 7995

    balance 2.5 * 615 = 1537.5

    Total = 11306.538 is it correct calculation for 18 years Indemnity or not.

  75. Calculation is wrong. Example a person earns 80 kwd , worked for 18 years.

    80 * 2.5 = 200 ( 1 – 5 years )
    80 * 13 = 1040 ( 5 – 18 years )

    Total —– 1240 .

    The app calculates 1270.769 . Which is totally wrong. Its my believe that they have taken 26 days as a whole month which is wrong.
